803.1How is evidence of control determined?
The factors, or elements, that show control over the details of work are discussed in §§804-823. These factors are weighed against and with factors that point to an employer-employee relationship or an independent contractor status. It is important to note that any single fact or small group of facts taken together is not necessarily evidence of control. Determining evidence of control is based on a careful evaluation of all facts collectively.
803.2How much weight is given to the factors of control?
The weight or amount of importance given to each factor is not always constant. Some factors are more important than others in determining evidence of control; also, the degree of importance changes by occupation. For example, some factors of control do not apply to certain occupations.
