Subject: Stieberger v. Sullivan

Background

On June 19, 1992, the United States District Court for the Southern District of New York entered a final judgment approving settlement in the Stieberger v. Sullivan class action involving the issue of acquiescence in Second Circuit disability decisions when adjudicating the disability claims of New York State residents. The court entered an order modifying the settlement on July 29, 1992.

Explanation of Content and Changes

This Temporary Instruction (TI) provides specific OHA instructions for implementing the district court's June 19, 1992 judgment approving settlement, as modified July 29, 1992, and replaces TI 5-413, TI 5-413 Supplement A and TI 5-413 Supplement B, Stieberger, et al. v. Heckler. Those TIs provided instructions for complying with an earlier district court order, which has been vacated.

This TI attaches the judgment approving settlement and the stipulation and order regarding modification of the settlement.
