Subject: Polaski, et. al. v. Bowen

Background

On July 17, 1984, the U. S. Court of Appeals for the Eighth Circuit issued an order setting forth the standard for evaluating pain and other subjective complaints. That standard has been in effect for all administrative and judicial proceeding involving Eighth Circuit residents since the court's order.

On April 12, 1985, July 18, 1888 and February 14, 1989, the U. S. District Court for the District of Minnesota issued orders regarding readjudication of certain claims which SSA denied before the Eighth Circuit issued its order of July 17, 1984.

Explanation of Content and Changes

This Temporary Instructions (TI) contains instructions for implementing the district court orders regarding readjudication by OHA of certain Polaski class member claims as well as information about the Eighth Circuit's order of July 17, 1984. This TI consolidates all information regarding the Polaski class action in one instruction.
