Subject: Initial Processing of a Request for Hearing

Background

This transmittal amends chapter I-2-0 of the Hearings, Appeals and Litigation Law (HALLEX) manual to clarify existing practice that good cause for untimely filing generally exists when an individual relies on an appointed representative to timely file a request for hearing and the representative fails to do so. We also made other formatting and language changes to conform with plain language writing requirements.

Explanation of Content and Changes

Citations: We added Social Security Ruling 91-5p to the list of citations.

I-2-0-60 A – We changed the title to “Considerations When Evaluating Good Cause.” We also removed the hyperlinks to the regulatory citations and incorporated the regulatory language into the section.

I-2-0-60 B – We changed the title to “Examples.” We also removed the hyperlinks to the regulatory cites and incorporated the regulatory language into the subsection. We added an additional example to clarify that good cause for untimely filing generally exists when an individual relies on an appointed representative to timely file a request and the representative fails to do so.

I-2-0-60 C – We changed the title to “Developing Good Cause” and made other minor language changes.

I-2-0-60 D – We made minor editorial and formatting changes for clarity.
