Subject: Fraud and Criminal Violations

Background

Pursuant to Public Law 103-296, the Social Security Independence and Program Improvements Act of 1994, the functions of the Secretary of Health and Human Services in Social Security cases were transferred to the Commissioner of Social Security, effective March 31, 1995. When the Social Security Administration (SSA) become an independent agency, the Office of the Inspector General (OIG) was established within SSA. Because of the increased role of the OIG, we are revising our procedures in order to reflect better coordination of fraud referrals by employees of the Office of Hearings and Appeals to the OIG.

Explanation of Content and Changes

This transmittal revises Chapter I-1-300.

We combined Sections I-1-301 and I-1-302 and included additional fraud violations which are subject to criminal prosecution.

We renumbered Section I-1-303 as Section I-1-302.

We renumbered Section I-1-304 as Section I-1-303 and provided improved guidance concerning the reporting of suspected fraud and criminal violations by OHA employees, representatives and claimants to the OIG.
