Subject: Class Action Implementation

Background

In January 1993, the Office of Disability published Program Operations Manual System (POMS) instructions to address jurisdiction for class action court case processing. Those instructions discussed OHA's role in case consolidation.

In developing parallel instructions for OHA regarding consolidation, the need for standardized OHA procedures for all aspects of class action implementation became evident. OHA concluded that a permanent, published guide to implementation would assist both SSA and OHA in negotiating future implementation orders or settlement agreements, provide guidance to drafters of HALLEX Temporary Instructions (TIs) and facilitate the clearance process for POMS instructions and HALLEX TIs for specific class actions.

Explanation of Content and Changes

This chapter introduces new material containing an overview of class action implementation and specific policy and procedural guidance with respect to various aspects of class action implementation at the OHA level.
