I-2-3-35.Adjournment and Continuance of Hearing

Last Update: 1/21/20 (Transmittal I-2-231)

If it becomes necessary after a hearing has begun to adjourn the hearing and continue it at a later time, Office of Hearings Operations management, through designated staff, will prepare and send a Form HA-L89 (Notice of Continuance of Hearing), together with a Form HA-504 (Acknowledgment Form), to the claimant as soon as the time for continuance is known.

NOTE:

Form HA-L89 is available in the Document Generation System. The distribution is the same as for the Notice of Hearing, except that we will mail or serve the Notice of Continuance of Hearing at least 20 days before the new hearing date. The date of hearing indicated in the Notice of Continuance of Hearing will be at least 75 days from the date we first sent the claimant a notice of hearing, unless the claimant has waived the right to advance notice. (See I-2-3-15, Notice of Hearing).
