Publication of Final Rules

The final rules on Continuation of Benefit Payments to Certain Individuals Who Are Participating in a Program of Vocational Rehabilitation Services, Employment Services, or Other Support Services were published in the Federal Register. The final rules will be effective on July 25, 2005.

Notice of Proposed Rulemaking

Proposed rules on Work Activity of Persons Working as Members of Advisory Committees Established Under the Federal Advisory Committee Act (FACA) were published in the Federal Register. These proposed rules promote Social Security Disability beneficiary participation in FACA committees by excluding earnings from substantial gainful activity (SGA) consideration. The public comment period will close on August 2, 2005.

Sources Sought Notice Request

A Sources Sought Notice for the Health Benefits Packages Project was posted on Federal Business Opportunities (FedBizOpps). The purpose of the project is to support and enhance other SSA demonstration projects so that chronic conditions and health of SSA demonstration participants can improve and increase the possibility of work. This notice includes a draft statement of work. The response date is August 5, 2005.

Notice of Proposed Rulemaking (NPRM)

Proposed rules on Helping Blind and Disabled Individuals Achieve Self Support were published in the Federal Register. These rules propose that we take into account the person's individual needs and his or her occupational goal in determining what a reasonable length of time is for that person to achieve his or her occupational goal. The public comment period expires on September 9, 2005.

Request for Proposal

The Request for Proposal for the Vocational Expertise Contract was published on Federal Business Opportunities (FedBizOpps). The project’s plan is to convene a multidisciplinary panel of experts to study how SSA uses vocational expertise in its disability determination process.  Proposals are due August 19, 2005.

Publication of Programmatic Instructions

SSA published instructions for the Program Operations Manual System (POMS). They were released to reflect revisions to our regulations for Cases involving participation in a vocational rehabilitation or similar program ("section 301"). All policies and procedures for the handling of "section 301" cases were consolidated into a newly created chapter DI 14500.000.

Publication of Programmatic Instructions

SSA published instructions for the Program Operations Manual System (POMS): Processing Continuing Disability Review (CDR) Work Issues in the Program Center (PC) - General. The purpose is to incorporate procedures for the program centers (PCs) using eWork in the adjudication of work issue continuing disability reviews (CDRs), establish procedures for issuing work report receipts received in the PCs and reported on CDR mailer forms, and eliminate the PC review of field office (FO) effectuated work issue determinations.

Publication of Programmatic Instructions

SSA published POMS instructions for the 4-State Benefit Offset Pilot Demonstration Project. The Office of Central Operations is responsible for operational activities for this project. For more information on the pilot, visit the Demonstrations section.

Ticket to Work Evaluation

The Ticket to Work Evaluation is beginning its third year.  One evaluation report is currently available.  The first round of the National Beneficiary Survey (NBS) to support the evaluation was completed in Fall 2004.  The second such survey began in February of 2005.

EXR Final Rules Published

The Expedited Reinstatement (EXR) Final Rules were published in the Federal Register. These rules implement section 112 of the Ticket to Work and Work Incentives Improvement Act of 1999. EXR allows SSDI and SSI disability beneficiaries, whose entitlement or eligibility had been terminated due to their work activity, to have their entitlement or eligibility reinstated in a timely fashion if they become unable to do substantial gainful work.

September 12-15, 2005
Youth Transition Demonstration Topical Conference

On September 12-15, OPDR staff and its Youth Transition Demonstration (YTD) technical assistance contractor (Virginia Commonwealth University) held the YTD Annual Topical Conference in Dana Point, California. The conference addressed approximately 75 attendees including staff members from all seven YTD projects and key stakeholders. Topics such as: State-Level Coordination of Transition Services; Customized Approaches to Job Development; The New Employment Paradigm; Promoting Financial Literacy; Promoting Youth Independence; Accessing Post-Secondary Education; and Promoting Employment Through Work Incentives and Waivers: Overcoming Obstacles to Implementation; were featured. On September 13, Dr. Harold Hodgkinson gave the Plenary Session Address, Demographic and Economic Trends Affecting the Transition of Adolescents and Young Adults with Disabilities.

Request for Proposal (RFP)

The solicitation for the Health Benefits Package was posted on the (FedBizOpps) website. The purpose of the Health Benefits Packages project is to support and enhance other SSA demonstration projects by designing health benefits plans for SSA disability applicants and beneficiaries so that chronic conditions and health can improve and increase the possibility of work. Proposals are due December 2, 2005.

Disability Mentoring Day

The Office of Program Development & Research served as the coordinator for SSA’s Disability Mentoring Day (DMD) activities. The Department of Labor in partnership with the American Association of Persons with Disabilities hosts DMD annually.  DMD is an opportunity for young people with disabilities to gain insight into career options through hands-on career exploration, job shadowing, and internship or employment opportunities.  SSA employees were paired with students from various schools from the D.C. and surrounding areas.

Mental Health Treatment Study

The Mental Health Treatment Study (MHTS), which will will provide treatment and employment supports to a nationally representative sample of Title II beneficiaries with chronic mental illness, held its start-up meeting. Attendees included SSA executives and staff and representatives from the six contracted organizations tasked to implement the study: Westat, The University of Maryland Baltimore County, Value Options, Dartmouth, the University of Texas at San Antonio, and Indiana University-Purdue University Indianapolis. The contractors provided SSA with an overview of the implementation plan. The MHTS Enrollment of participants is expected to begin in April 2006.

Pre-Conference Announcement

The Office on Disability in the Department of Health and Human Services (HHS) is sponsoring a pre-conference entitled, Addressing the Healthcare and Wellness Needs of Women of Color with Disabilities: “Minding the Gap: Access, Availability and Services.”  This conference will be held on Sunday, January 8, 2006 from 1:00 pm - 6:00 pm at the Grand Hyatt Hotel in Washington, DC. Notice of Proposed Rulemaking (NPRM)

Proposed rules on the Continuing Disability Review Failure to Cooperate Process were published in the Federal Register. The public comment period expires on February 3, 2006. Currently, if a beneficiary fails to cooperate during a continuing disability review (CDR), the CDR goes to the Disability Determination Services (DDS) for a medical determination. These rules propose to place a beneficiary in suspense if the beneficiary fails to cooperate with the field office (FO) during a CDR. The FO will place the beneficiary in suspense for 12 months. If the beneficiary does not cooperate during the 12-month period of suspense, benefits are terminated in the 13 th month. The CDR is not sent to the DDS for a medical determination. If the beneficiary cooperates during the 12-month period, benefits will be resumed and any retroactive benefits that are due will be payable. The beneficiary will not have to file an appeal for benefits to be resumed.
