Subject: Issues Before the Administrative Law Judge

Background

This transmittal clarifies and updates the procedures relating to issues before the Administrative Law Judge contained in HALLEX Chapter I-2-2. These changes eliminate outdated references to Black Lung Benefits and the Medicare program. The updates also reflect changes in the Code of Federal Regulations (CFR), and include hyperlinks to other relevant sections of the Act, the CFR, and to cross- references within the HALLEX.

Explanation of Content and Changes

I-2-2-10 is edited for style and clarity.

I-2-2-92 adds sample language for Title XVI child's disability issues in the notice of hearing.

I-2-2-93 adds sample language for deductions, reductions, and nonpayment of benefits issues in the notice of hearing.

I-2-2-97 is a new section with sample language that may be used in the notice of hearing in various circumstances regarding adult disability cases.

I-2-2-98 is a new section with sample language for the notice of hearing in adult cessation cases.

I-2-2-99 is a new section with sample language for the notice of hearing when drug addiction and alcoholism is at issue.

I-2-2-100 is a new section with sample language for the notice of hearing in an expedited reinstatement case.

I-2-2-101 is a new section with sample language for the notice of hearing when fraud or similar fault is at issue.

Updated regulatory references have been added and editorial revisions made throughout the chapter.
