Subject: Issues Before the Administrative Law Judge

Background

This transmittal amends section I-2-2-25 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions relating to the expedited appeals process.

Explanation of Content and Changes

I-2-2-25 – We changed the title to “Expedited Appeals Process – Constitutional Challenge to Social Security Act” to better reflect the content of the section.

I-2-2-25 A – We changed the title to “General” and mirrored the language in HALLEX I-3-0-65 and I-4-1-42.

I-2-2-25 B – We moved the information previously in the subsection to subsection C and changed the title to “Expedited Appeals Process (EAP) Request Jurisdiction.” We incorporated information previously in subsection C and modified the language to mirror HALLEX I-3-0-65 and I-4-1-42 as closely as possible.

I-2-2-25 C – We moved some of the information to subsection B and changed the title to “Hearing Level EAP Procedures.” We incorporated information previously in subsections B and D, removed duplicate information, and updated the procedures for the expedited appeals process. We added a NOTE explaining that if the EAP requester and the agency cannot reach agreement, the EAP request must be denied. We also made several editorial and formatting changes to improve readability.

I-2-2-25 D – We moved the information previously in this subsection to subsection C and deleted subsection D.
