Prepare the decision and proofread the typed material.
NOTE:
Before preparing a favorable decision, the analyst must first obtain either a Detailed Earnings Query (DEQY) or Summary Earnings Query (SEQY) and place it in the claims file to ensure there is not substantial gainful activity after the proposed onset date.
If the decision is completely accurate, forward the file with the decision (and initial or supplemental analysis, when appropriate) to the Appeals Council.
If the claimant has requested correspondence in Spanish or the file indicates there is a need to communicate with the claimant in Spanish, the Office of Appellate Operations (OAO) Branch staff will prepare the appropriate Spanish language version of the cover notice concerning the claimant's court's rights (See I-3-1-60).
If the claimant resides in a foreign country, the analyst must annotate the route slip to advise the Appeals Council support staff to modify the covering letter regarding where a civil action may be filed.
The route slip should state that the claimant resides in a foreign country and whether or not the claimant has a principal place of business within a judicial district of the United States.
Residents of Puerto Rico, Guam, the Northern Mariana Islands and the Virgin Islands are considered United States residents.
In favorable decisions where the claimant is represented and the file contains a fee agreement, the analyst must annotate the route slip to advise the branch staff to forward the claims file to the Attorney Fee Branch prior to review by the AAJ.
